J's mom,

1. Gather all your inspection papers together, along with seller disclosures. If it is common knowledge in your area that the Kitec fittings have caused problems at the time your purchased the home, you have a legal claim against the listing broker (who represented the seller), the seller and the selling broker (who represented you). It appears there is a class action suit in the works.  Here is the link (looks like same link as the one Belinda posted but different area)

http://www.plumbingdefect.com/faqs.html

2) Have you contacted your real estate agent?  It's hard for me to believe that any experienced professional agent who knows about potentials issues would not disclose them on his/her portion of the disclosure statement. In Calif. there are specific sections where the two agents must disclose his/her findings upon a visual inspection.  Of course, the plumbing would not be visible. Presumably the Realtors have some local knowledge in that part of the area (city, county).

3) It is possible the the seller had at one point engaged a vendor to do some plumbing work. The vendor might have used the Kitec fittings w/o knowing the they were going to be defective in the future.  In which case, none of the potential defendants in a law suit knowingly intended to hide any defective condition in the home.  Are they still liable? - maybe not - however, in all likelihood, all defendants (or more accurately, their insurance companies) will pony up to pay for damages.

4) So your next step would be to find out specifically what caused the damage and extend of the damage.

5) You might want to contact a lawyer who specializes in construction defect cases in your local area.  You might even find a few who know about this already. Please read the info from the link - it provide several recommended companies to hire in case you are going to have the plumbing fixed.  My personal take on this is that if there has been a law suit filed prior to your purchasing the home and this is a known issue, then both Realtors involved should have known about the plumbing problems with the builder of your subdivision.  Attorneys for real estate companies are very pro active in trying to prevent going to court. If this was a known issue, there would have been alerts sent to Broker and on down to the managers of each office.  If your Realtors was an independent broker (one person office) and from out of the area, it's possible that he/she might not have known.  It doesn't necessarily exonerated him/her. She will still be on the hook and most definitely named in a law suit.

I am sorry to hear about your problems. My apologies for rambling. I had root canal surgery this morning and feeling under the weather and not thinking clearly.

If you have a specific question, please feel free to ask. I will answer when I can.

Regards,

aw J! I wish I would have known--we learned the hard way when stinking Target moved Jeff 6 1/2 years ago with 3 days notice and a promise to buy our house. We had only been in it 2 years and had paid for the same home inspection. Those arent worth the paper they are written on. If you have a real plumber, real electrician, real what ever come in and do the specific inspection, it costs more but if they didnt do an appropriate inspection, you can go back on them and they have to repair the things they missed at their cost. They are much more thorough because of that factor.

Needless to say, in our case Target backed out of the house deal and then fired Jeff for complaining too much about them not buying the house. That's why I cannot figure out where I am since I had to stay in KY to make enough for the house payment while the kids, dogs, furniture etc were in NY. I really HATE Target which I refer to as "that place". I cannot go in any of them because I am afraid my "coo coo for coco puffs" diagnosis will cause me to do something that will get me arrested!

I'll have to check on the goo factor invention--although that may take a few days since, as he is a real nuke, I am not sure if he got home safely from Thanksgiving yet since he never answers his phone!

Mark, that's hysterical!  Those kids are always thinking, aren't they?  At least they use their powers for good (most of the time)  :^)

That boy is a nuc, fer sure:) ; I wonder if he's jury-rigged some sort of a dome, so that the cheese can develop the proper goo factor....

That had got to be the cutest most creative way I have ever heard of making grilled cheese. God Bless your son!

Oh Mary--I know they all have irons--this one is Bink's dedicated food iron that he used to cook in his room since they cant have toasters, hotplates or microwaves. He wanted grilled cheese one evening and had bread and cheese so he used his iron to grill it. That's what his picture is: the ordinary iron glorified into a cooking utensil!

Comment by Binker & Bro: 2X Nuke Mom on December 8, 2011 at 11:06am

for those with kids still in GC barracks--perhaps a new iron for Christmas. @@@@ (oops--accidentally wrote the real name for a moment). Binker became quite adept (according to him and pictures posted on FB) at creating sandwiches such as grilled cheese on his specially dedicated "food iron".the finished product!
